In recent years time, the Ministry of Construction received the letters  from  the  various localities and enterprises inquiring about the application of codes norms and  standards related concerning to evaluation and approval of projects of urban and housing. In there, many local authorities use the criteria about unit amount (apartment) when considering and approving detailed construction planning 1 / 500, evaluating basic design for projects of urban and housing, with the calculation of an apartment  having 4 persons but not consider the size of apartment, make many enterprises meet trouble, especially if they invest apartment building with average area (around 50-70m2. However, construction planning regulation promulgated under Decision No. 04/2008/QD-BXD dated 03/4/2008 of the Minister of Construction only  limit  the area of minimum  land use area and maximum coverage area ratio (following the area of land and building height) and not limit apartment number when making investment in urban area, apartment building.

If applying According to norms  in construction planning regulation about  land use  area,  coverage area ratio
and floor area ratio, and limit the number of apartments with a calculation of an apartment with
04 people  it will indirectly  limit  the average area of apartments (average area of apartments  is
equal to the total floor area of the apartment / population x 04). In many cases, the average area
of apartments will be restricted in high levels (about 120m2

), so investors have trouble to build
apartments with an average area, in conformity with the income of most the households.

is not reasonable, especially in apartment with 50-70m2
Controlling the number of apartments, calculating 4 people in an apartment also lack the basis
and not be suitable any longer (According to statistics on population and housing in 4 / 2009 The
average household in a nationwide  is 3.8 people, 3.6 people in Hanoi and Ho Chi Minh City is
3.8 people). 

On the other hand, under the current regulations on housing,  enterprises  are allowed and
encouraged to invest in building apartments with suitable area (over 45m2) to meet the middle-
income and  low income  subjects  (Item 1 Article 40 of the Housing Law  regulate  floor area of
commercial apartments shall not be less than 45m2;  Article 4 of Decision No. 67/2009/QD-TTg on 24/4/2009 by the Prime  specify  that  floor area of apartments  for low-income subjects must
not exceed 70m2
So, to create conditions  for investors to build housing,  the Ministry of Construction proposed
People’s Committees of provinces and cities agreed to direct units and enterprises in the province
to appraise and approve projects of urban and housing as follows:

Reviewing the criteria on land use area equivalent to the population, floor height, coverage area
ratio  and  floor area ratio  as the prescribed construction planning regulation  issued under
Decision 04/2008/QD-BXD, do not apply to calculate an apartment equivalent to 4 people for all
types of apartment to control the number of apartments in housing projects.
If considering  the number of apartments and compare between design population and approved
population, it can  be applied  TCXDVN 323:2004 "high-rises building  – Design standards" to
calculate for each type of apartments by area (type A  is  from 50-70m2
  area equivalent to 1-2
persons per household; Type B is from 75-100m2
equivalent to 3-4 persons per household; Type
C is 105m2
Above is the opinion of the Ministry of Construction on the evaluation and approval of
projects of urban and housing. Recommend People’s Committees of provinces and cities to direct
units and enterprises.
